Divorce Lawyer FAQ

  • What are the grounds for divorce in North Carolina?

At least one party must have resided within the state for a minimum of six months and the couple must be living separate and apart for at least one year.

  • How long does the divorce process take?

Once the one-year separation requirement is met, an uncontested divorce can take as little as 45–90 days. Contested divorces involving custody, property, or alimony may take longer depending on the complexity of the case.

  • Can I get divorced if my spouse is in the military?

In at-fault divorces, the court takes into account the actions of the involved parties, such as adultery, abuse, or imprisonment. North Carolina, however, is a no-fault state.

  • What happens to our property during a divorce?

North Carolina uses “equitable distribution” to divide marital property. This doesn’t always mean a 50/50 split, it means a fair division based on factors like income, contributions, and future needs.

  • Do I need a lawyer if my divorce is uncontested?

An Absolute Divorce action costs $75 to file. There will likely be additional expenses associated with serving the other party, filing documents with the court, etc.

  • How much does it cost to hire a divorce attorney?

Costs vary depending on the complexity of your case. We offer consultations to help you understand the process, your options, and expected fees before moving forward.
